BASIC TERMS USED HERE

 

Terms and Conditions (T&Cs) – the terms and conditions for the Transkryptor.pl online services

 

Website – a website hosted by Transkryptor at www.transkryptor.pl

 

Transkryptor „Kudelski Communications” Krzysztof Kudelski, based in Sopot, with the following mailing address: ul. Kościuszki nr 16/2, and the following tax identification number: 1181587735 and company registration number: 141250495

 

Service(s) – transcribing AV materials, translating and/or typing texts, closed captioning, as well as ordering a cost estimate of transcribing AV materials, translating and/or typing texts, closed captioning, including contacting Transkryptor by using the contact forms.

 

User – an individual visiting the Website or using the Services available on the Website

 

Registered User – a User having an account on the Website

 

 

INFORMATION about the WEBSITE

 

The owner of the Website allowed to host its resources is Krzysztof Kudelski, running a companyunder the following business name: “Kudelski Communications” Krzysztof KudelskiTranskryptor.

 

The Website provides information and allows Users to familiarize themselves with the Transkryptor’s offer, as well as to use the functionalities of the Website and Services provided by Transkryptor related to transcribing AV materials, translating and/or typing texts, and closed captioning.

 

 

GENERAL TERMS and CONDITIONS of USING the WEBSITE

 

Using the Website requires that the device used by the User meets minimum technical requirements, including the following:

 

·       Standard operating system

·       Standard Internet connection

·       Standard installed Web browser

·       Active email account

While using the Services available on the Website, the User may not provide any illegal content, especially content violating the rights of third parties, content flouting binding legal regulations or the principles of social coexistence, including content violating intellectual property rights or confidentiality clauses or content that constitutes an act of unfair competition. Transkryptor underlines that sending an AV material of individuals who have not provided their consent to being recorded either for the sake of estimating the costs of transcribing the material or for the sake of ordering a transcription is prohibited.

In the case of receiving a file that contains prohibited content Transkryptor immediately removes the file and refuses to provide the relevant Service.

 

 

SERVICES CALCULATORS

 

This functionality allows the User to receive an initial cost estimate of the Service of transcribing a specific AV material, translating a specific text or typing it, or preparing closed captions for AV materials.

 

By means of the form available under:

The User can estimate the cost of the Service provided by Transkryptor. To this end, the User has to fill in a form and provide information concerning the recording or text, checking the relevant fields in the form that relate to basic parameters, such as duration, language, type of AV material (or a text if applicable) and the expected deadline for providing the Service as well as additional parameters, such as automated transcription option, noises or inaudible voices, and marked accents and / or others. After filling in all the fields in the form, the User receives a net cost estimate provided in Great British Pound (GBP).

 

Using the Service Calculators is free of charge and does not require the User to have an account.

 

 

PLACING the ORDER for COST ESTIMATE

 

The Website offers the possibility of ordering a cost estimate of transcribing an AV material, translating or typing a text, and closed captioning. In order to use this Service, it is necessary to fill in a contact form and provide the following details:

·       name and surname (marked as required)

·       email address (marked as required)

·       phone number (optional)

·       additional information, e.g. a description or relevant details concerning the recording or the text (optional)

·       The User may also upload the recording or the text which is the object of the cost estimating.

 

The possibility of ordering a cost estimate of transcribing an AV material, translating or typing a text, and closed captioning, is not a commercial offer as understood within the relevant articles of the Polish Civil Code.

 

The final cost of the Service is calculated individually with the User by email (i.e. the message is sent to the email address provided in the contact form), following the analysis of the recording or translation, or text, or closed captioning, done by Transkryptor.

 

The analysis is carried out on the basis of the relevant details of the recording, or translation, or text, or closed captioning material, including the actual duration, language and recording/text type, as well as the expected and possible deadline for providing the Service. Additional parameters, such as potential noises or an inaudible voice, a marked accent or the “automated transcription” option, and/or others are also included in the analysis.

 

Using the Service is free of charge and does not require the User to have an account.

 

 

PROCESSING the ORDER

 

By using the order form available under [Order Now] the User can place an order for transcribing a recording, or transcribing a text, or a translation, or closed captioning, Using this Service does not require the User to have an account.

 

Ordering a transcription

 

In order to place an order for transcribing a recording the User has to provide information about the recording, checking the relevant fields in the form related to the following parameters of the recording:

·       time duration (minutes and hours)

·       language (Polish, English, Spanish, Italian)

·       recording type:

o   individual interview

o   focus group

o   court trial

o   conference

o   presentation

o   voice memo

o   other

 

·       expected deadline for transcribing the recording as well as

·       additional parameters, such as

o   „automated transcription” option

o   noises

o   specialist language

o   other

o   marked accent

o    

After filling in all the fields in the form, the User receives a net cost estimate provided in in British Pounds (GBP).

 

Next, the User uploads the file with the recording to be transcribed and provides the following details which are required in order to process the order:

·       name and surname (marked as required)

·       email address (marked as required)

·       phone number (optional)

·       additional information, e.g. a description or relevant details concerning the recording or the text (marked as required)

 

Ordering a translation

 

In order to place an order for translating a file the User has to provide information about the file, checking the relevant fields in the form related to the following parameters of the file:

·       number of characters with spaces [choosing the right frame]

·       language pair [Polish to English, English to Polish, Polish to Spanish, Spanish to Polish, Italian to Polish, Polish to Italian]

·       translation type:

o   Generic content

o   App / Website User Interface

o   Legal / Contractual

o   Medical

o   Technical

o   Finance

·       expected deadline for transcribing the recording as well as

·       additional parameters, described in the “Additional information” field.

 

After filling in all the fields in the form, the User receives a net cost estimate provided in in British Pounds (GBP).

 

Next, the User uploads the file that needs to be translated and provides the following details which are required in order to process the order:

·       name and surname (marked as required)

·       email address (marked as required)

·       phone number (optional)

·       additional information, e.g. a description or relevant details concerning the recording or the text (marked as required)

 

 

 

Ordering a text typing / transcription

 

In order to place an order for transcription a text file the User has to provide information about the file, checking the relevant fields in the form related to the following parameters of the file:

·       number of characters with spaces (choosing the right frame)

·       language (Polish, English, Spanish, Italian)

·       translation type:

o   Generic content

o   App / Website User Interface

o   Legal / Contractual

o   Medical

o   Technical

o   Finance

o   other

 

·       expected deadline for transcribing the recording as well as

·       additional parameters, described in the “Additional information” field.

 

After filling in all the fields in the form, the User receives a net cost estimate provided in in British Pounds (GBP).

 

Next, the User uploads the text file that needs to be transcribed and provides the following details which are required in order to process the order:

·       name and surname (marked as required)

·       email address (marked as required)

·       phone number (optional)

·       additional information, e.g. a description or relevant details concerning the recording or the text (marked as required)

Ordering closed captions

 

In order to place an order for closed captioning service the User has to provide information about the recording, checking the relevant fields in the form related to the following parameters of the recording:

·       time duration (minutes and hours)

·       language (Polish, English, Spanish, Italian)

·       recording type:

o   individual interview

o   conference

o   presentation / webinar

o   voice memo

o   YouTube video

 

·       expected deadline for transcribing the recording as well as

·       number of speaker, and

·       additional parameters, such as

o   „automated transcription” option

o   distorted AV material

o   specialist language

o   marked accent

 

After filling in all the fields in the form, the User receives a net cost estimate provided in in British Pounds (GBP).

 

Next, the User uploads the file, or send a link to the AV material that needs closed captioning, and provides the following details which are required in order to process the order:

·       name and surname (marked as required)

·       email address (marked as required)

·       phone number (optional)

·       additional information, e.g. a description or relevant details concerning the recording or the text (marked as required)

 

 

Payment

 

The next step is choosing the payment method for the Service of transcribing / translating / text typing or closed captioning. The User may choose one of the following methods:

·       card payment / debit and credit card via Stripe™

·       Paypal

·       Traditional Bank Transfer (upon sent invoice)

 

Card payments are processed by Stripe. We accept the following credit and debit cards: VISA, MasterCard, American Express, Discovery. Transkryptor does not charge any commission from the User when choosing the payment method.

 

The User shall pay for the Services by debit or credit card or using PayPal, Inc. immediately after submitting an order for a Service and (or) receiving an invoice and (or) a payment link thereof.

 

 

Completing the order

 

After submitting the form along with the attached files and paying for the order, the User receives an email confirming the order placement. In the case of choosing the traditional bank transfer payment method, the User shall contact Transkryptor, and transfer the money to the provided bank account within 24 hours following the submission of the form. If that payment deadline is not met, Transkryptor deletes all attached files and does not complete the order.

 

After receiving the order and the payment, Transkryptor analyses attached files (recording, text, links, or other attachments required to complete the service), to see if the information provided by the User in the form is correct. If the parameters indicated in the form are correct and if Transkryptor accepts the deadline indicated by the User as feasible, Transkryptor sends the User an email confirming the completion of the order and the deadline for providing the transcription, or text transcription, or translation, or closed captions, and then starts transcribing the recording / text, or translating, or closed captioning.

 

After finishing the Service, Transkryptor sends the User the transcribed text, or translation, or closed captions file, using the email address provided in the form.

 

Using the Service is free of charge and does not require the User to have an account.

 

Cancelling or modifying the order

 

If Transkryptor observes any discrepancies between the parameters of the recording (or text, or other attachment required to complete the Service) indicated in the form and the recording (or text, or other attachment required to complete the Service) uploaded by the User, Transkryptor may cancel the order by sending the User an email stating that the order will not be processed and by reimbursing the payment made by the User at the order placement within 7 working days following the sending of the email about cancelling the order.

 

If Transkryptor observes any discrepancies between the parameters of the recording (or text, or other attachment required to complete the Service) indicated in the form and the recording (or text, or other attachment required to complete the Service) uploaded by the User, Transkryptor may also contact the User by email in order to provide the right cost estimate and the new deadline for providing the Service. If the User accepts the new price and deadline by replying to the email, the User has to pay the remaining amount (in the case when the new price is higher than the cost estimate indicated in the form) or Transkryptor has to reimburse the excess amount of the payment (in the case when the new price is lower than the cost estimate indicated in the form). If the User does not accept the new price and deadline, Transkryptor cancels the order according to the terms and conditions described above.

 

Transkryptor cancels the order also in the case when the User submits a file with material with illegal content.

 

The User may cancel the order for a Service within fourteen days following the order placement without providing any reasons unless the Service has been already provided or its provision has been commenced. In that case, cancelling the order is possible only when the costs of providing the Service incurred by Transkryptor have been covered.

 

The User accepts the following:

 

The User acknowledges that Transkryptor bills per minute of recorded audio for transcription and not on page count, number of characters, or work hours. The User agrees to pay the rates prevailing at the time the Service is requested as set forth in the Pricing section of Transkryptor's Website.

 

The User also acknowledges that for text transcription and translation Services, pricing is based on the number of characters in the source text. The User also acknowledges and that variables may increase the price. Transkryptor will notify the User of any increased costs as it relates to the price, time, or completion of the order

 

All charges quoted to the User shall be exclusive of VAT, which Transkryptor shall add to its invoices at the appropriate rate. If you are an individual customer, ordering a Service, please contact us primarily via contact form or on transkryptor@transkryptor.pl for individual pricing. All individual selling services which shall be rised by VAT, relatively to place of residence.

 

 

RREGISTERING and SIGNING UP

 

The User may create a User account on the Website, which is an additional functionality.

 

Creating a User account is free of charge.

 

In order to register and create a User account it is necessary to fill in the registration form and provide the following details:

·       email address (marked as required)

·       username (marked as required)

·       password (marked as required)

 

and to accept these Terms and Conditions.

After filling in and submitting the registration form by the User, Transkryptor will send a message to the email address indicated in the form with the confirmation of the registration and creation of the User account.

 

By creating the User account, the User will be able to:

 

·       track the history of orders

·       monitor the order processing by having an overview of a draft of the transcription, translation or the typed text, or closed captions, depending on the current stage of the process

·       The User will not have to provide personal details when placing a new order and making the payment.

The User has access to the account and may change personal details whenever needed or delete the account.

 

 

COMPLAINTS

 

The User who has placed an order for a Service of transcribing a recording, text, or translation, or closed captioning, on the Website may lodge a complaint concerning the chosen service within fourteen days following the receipt of the transcription, text transcription, translation or closed captions, by sending an email to transkryptor@transkryptor.pl.

 

Transkryptor responds to the complaint of the User within three days and if the complaint is deemed valid, Transkryptor will correct the transcription, text transcription, translation of closed captions, and send the corrected text to the email address of the User indicated in the form within three days.

 

LIABILITY

 

Transkryptor is not liable for any delays in processing the order for services, resulting from circumstances beyond Transkryptor’s control, especially resulting from the event of force majeure.

If the file with the recording, or text,  to be transcribed, translated, or closed captioned, is deemed to contain material that violates the rights of third parties, the User does not impose the liability for violating the rights of third parties on Transkryptor.

 

PERSONAL DATA PROTECTION

 

The rules regarding the protection of the Users’ personal data are included in the Privacy Policy.

 

CONFIDENTIALITY

 

Transkryptor ensures that all information obtained as part of the provision of the Services, in particular as part of the processing of the order for transcribing a recording /or text, or translating, or close captioning, is confidential.

 

At the User’s request, it is possible to conclude a separate confidentiality agreement.

 

 

 

VALIDITY and UPADATING of TERMS and CONDITIONS

 

These Terms and Conditions are effective from December 1, 2023. They are verified on an ongoing basis and may be amended or updated if necessary. After introducing the update, we will make the new version available on this Website and inform the Website Users about it.

In matters not regulated in these Terms and Conditions, the provisions of the Polish Civil Code, the Act on the Provision of Electronic Services and other provisions of generally applicable law shall apply.

With concern for your  privacy and security of personal data, we present to you the rules of processing and protection of personal data concerning the Users using the www.transkryptor.pl website (“Service”), included in this document (“Privacy Policy”).

 

The protection of the Users’ personal data is of upmost importance to us, which is why we apply appropriate technical and organizational solutions aimed at securing the Users’ privacy against violations by third parties and the sense of security of the User using the Transkryptor’s services through the Service.

 

 

PROCESSING OF PERSONAL DATA
RELATED TO USE OF THE SERVICE

 

The administrator of the personal data provided by the User on the www.transkryptor.pl website (“Service”) is „Kudelski Communications” Krzysztof Kudelski, based in Sopot, at 16 Kościuszki Street, premises 2, using NIP number 1181587735, REGON number 141250495 („Administrator” or „Transkryptor”).

 

A user of the website is any person to whom data pertains who uses the Service or electronic available through the Service (“User”). Such services are:

·       The possibility of establishing contact with the Transkryptor through the contact forms

·       Ordering an estimated quote for transcription, text translation or text typing, or closed captioning

·       Placing an order – performing transcription, translation or text typing, or closed captioning

 

Users’ personal data are processed on the basis of European Parliament and Council Regulation (EU) 2016/679 from April 27, 2016 on the protection of individuals with regard to the processing of personal data and repealing Directive 95/46/WE (general data protection regulation) („RODO”), and also on the basis of UK GDPR (General Data Protection Regulation) from 31st of December 2020.

 

PURPOSES AND LEGAL BASIS OF PERSONAL DATA PROCESSING

 

The processing of your personal data is carried out in relation to the following functionalities of the Service:

 

1.             Users’ use of the Service – both:

¾  without registration/having an account, as well as

¾  by Users registered/having an account in the Service.

Providing the above information is necessary in order for the recipient of the message – Transkryptor – to contact the User and respond to the inquiry. Provision of data marked as mandatory is required in order to receive serve the inquiry and the failure to do so will result in the inability to take these actions. Providing the other data is voluntary.

 

The above personal data are processed in order to identify the User sending the message and to service their inquiry – the processing of the data is necessary to execute the service contract (Article 6(1)(b) RODO). Regarding the data provided on an optional basis, the legal basis for their processing is the User’s consent (Article 6(1)(b) RODO).

 

3.             Ordering an estimated quote for transcription, translation or text typing, or closed captioning service

 

As part of the Service, you also have the option to order a quotation of transcription, translation or text typing, or closed captioning service free of charge. Using this option requires you to provide the following information:

·       First and last name  (marked with an asterisk as required)

·       E-mail address (marked with an asterisk as required)

·       Phone number (optional).

 

Providing the above information is necessary to provide an estimated transcription quote – providing a quote for transcription, translation or text typing, or closed captioning service. Providing data marked as required is necessary in order to approve and execute an order and failing to do so will result in the inability to take these actions. Providing the other data is voluntary.

 

The above personal data are processed in order to identify the User placing an order for an estimated quote for transcription, translation or text typing, or closed captioning –  the processing of the data is necessary to execute the service contract (Article 6(1)(b) RODO). Regarding the data provided on an optional basis, the legal basis for their processing is the User’s consent (Article 6(1)(b) RODO).

 

4.             Registration and creating a User Account

 

The User decides for oneself whether and to what extent they use the services offered in the Service, and whether and to what extent they share information about themselves. The User may choose either to use the Service without registration and logging in, or to create an account (registration) and use the functionalities available to logged-in users. Registration in the Service is free of charge and voluntary. The data necessary for registration, which are gathered by the Administrator, are:

·       Password (marked with an asterisk as required)

The above data is used by the Administrator to operate the user’s account (Article 6(1)(a) RODO).

 

5.             Placing an order for the Service of providing transcription, translation, text typing, or closed captions – via the order form.

 

Through the Service, you can also place an order for the transcription, translation, text typing, and closed captions. For this purpose, it is necessary to provide the following information:

 

·       First and last name (marked with an asterisk as required)

·       E-mail address (marked with an asterisk as required)

·       Residential address (marked with an asterisk as required)

·       Attachment of source file (marked with an asterisk as required)

·       Phone number (optional).

 

Providing the above information is necessary to execute the Service – providing transcription, translation, text typing, and / or closed captioning. Providing data marked as required is necessary in order to approve and execute an order and failing to do so will result in the inability to take these actions. Providing the other data is voluntary.

 

The processing of data in this regard is necessary for the execution of a contract to which the User to whom the data relates is a party, or to take action at the request of the person to whom the data relates prior to the execution of the contract (art. 6 ust. 1 lit. b RODO).

 

6.             Payment service

 

Through the Service Users pay for the order placed for the Services of transcription, translation or text typing, or closed captioning, using a payment card, PayPal, or by bank transfer based on an invoice. For this purpose, it is necessary to provide the following information:

·       First and last name (marked with an asterisk as required)

·       Card number (marked with an asterisk as required)

·       CVV/CVC number (marked with an asterisk as required)

·       Address

·       Company data, such as Address and VAT number

·       [… - e.g., data by which the owner can be identified – when paying based on an invoice].

 

Providing the above information marked as required is necessary for payment processing and order acceptance and execution, and failure to do so will result in an inability to take these actions.

 

The processing of data in this regard is necessary for the execution of a contract to which the User to whom the data relates is a party, or to take action at the request of the person to whom the data relates prior to the execution of the contract (art. 6 ust. 1 lit. b RODO).

 

7.             Execution of the Administrator’s legal obligations

 

Transkryptor processes personal data in order to execute its legal obligations, in particular those related to the functioning and operation of the Service, the provision of Services, as well as those related to tax settlements and the maintenance of accounting – the processing is necessary for the execution of the Administrator’s legal obligation (Article 6(1)(c)( RODO).

 

8.             Execution of the Administrator’s rights

 

Transkryptor processes personal data in order to possibly establish and assert or defend against claims, in terms of protecting its rights (Article 6(1)(f) RODO).

 

9.             The execution of analytical and statistical purposes – in accordance with the Administrator’s legitimate interest in analyzing the activity of Users in the Service (Article 6(1)(f))

 

10.         The execution of marketing purposes – with the user’s consent given during registration (when creating a User Account) (Article 6(1)(a) RODO)

 

 

RECIPIENTS OF PERSONAL DATA

 

The recipient of Users’ personal data is the Administrator.

 

In relation to the performance of the Services, User’ personal data may be transferred to entities that process data on behalf of the Administrator, i.e. IT service providers, entities that provide accounting or technical services to the Administrator. These entities may process personal data on behalf of the Administrator under an agreement for further entrustment of personal data processing.

 

The Administrator has the right to disclose Users’ personal data to authorized entities or institutions, based on an appropriate legal basis, and in accordance with the provisions of applicable law, or when it is necessary to execute the Agreement in relation to the Services provided by the Administrator.

 

 

PERIOD OF PERSONAL DATA PROCESSING

 

The Administrator will process your personal data for a specific period of time.

 

The following is the detailed listing of the processing periods for specific data and processing purposes:

 

1.     for the entire duration and performance of the electronic provision of the Services and the duration of the Agreement for the execution of the Services, and after its termination, for the period determined on the basis of the relevant tax and accounting periods and periods of limitation of claims

2.     for accounting and tax purposes – for 5 years calculated from the end of the calendar year

 

Transkryptor cares about the comfort and security of both Users using the Service without registration and Users having an account but inactive – not using the Service. Therefore, the data of those of you who have registered in the Service, but for 3 years from the date of account creation have not used the Services available in the Service, will be safely deleted and will no longer be processed. 

 

USER RIGHTS

 

Since Transkryptor processes your personal data, the following are your rights – as Users of the Service.

Users have the right to:

·       access to the personal data content (according to Article 15 RODO)

·       prompt rectification of the personal data that is inaccurate (according to Article 16 RODO)

·       erasure of the personal data – known as the “right to be forgotten” (according to Article 17 RODO)

·       restriction of the personal data processing (according to Article 18 RODO)

·       portability of the personal data (according to Article 20 RODO)

·       object to the personal data processing (w according to Article 21 RODO)

·       lodge a complaint to the President of the Office for Personal Data Protection, 2 Stawki Street, 00-193 Warsaw, in case it is determined that the protection of the User’s personal data has been violated or if the User considers that the personal data processing violates the provisions of the RODO.

·       withdraw consent to the personal data processing, provided that the User has consented to the processing of their data – to the extent that the User's data is processed on the basis of their consent. Withdrawal of consent is possible by emailing transkryptor@transkryptor.pl.

·       consent at any time without affecting the legality of the processing carried out on the basis of the consent in question before the indicated withdrawal.

Through the Service, it is possible to access other third-party sites and sites and services, i.e. social media such as Facebook and X (formerly Twitter). Sharing information on Facebook or X (formerly Tweeter) is subject to the privacy policies of each of these sites. In addition, both services may share information with the Administrator regarding the User’s visits to their sites. You may change your privacy settings on Facebook or X (formerly Twitter).

GOOGLE ANALYTICS

Transkryptor uses Google Analytics – tools used to analyze web traffic. They collect information about your visits to the Service – sites that have been visited and the subsites that have been displayed, the time that the User spent on a given site or subsite of the Service, as well as the transitions between different sites and subsites.

For this purpose, cookies from Google LLC, 1600 Amphiteatre Parkway, Mountain View, CA, 94043, USA, concerning the Google Analytics service are used. As part of your cookie settings, you can decide whether or not you consent to the collection to the abovementioned data.
